The Tax Agency appeals against the County Administrative Court’s judgment
The dispute basically concerns a deduction of SEK 5 billion from the time when Klövern was an IT company. The Tax Agency considered that the deduction should not be consented to and moreover imposed a tax surcharge of SEK 493 million despite Klövern withdrawing its application for a deduction. The issue of the imposition of the tax surcharge was considered by the county administrative court separately from the issue of the deduction. Klövern won the dispute at the country administrative court as regards the tax surcharge.
“Of course, we had hoped that the Tax Agency would accept the county administrative court’s assessment and not pursue the matter of a tax surcharge further. Unfortunately, the Tax Agency has now decided to appeal and we will have to await the result at the administrative court of appeal”, says Klövern’s CEO Gustaf Hermelin.
“The county administrative court shared our view and quashed the tax surcharge. Bearing in mind the county administrative court’s clear judgment, we are optimistic that the administrative court of appeal will draw the same conclusion”, say Klövern’s attorney-at-law Börje Leidhammar, Wistrand advokatbyrå and Thomas Andersson, Deloitte.
As previously notified, after withdrawing the application for a deduction, Klövern requested a new reconsideration of the capital loss of SEK 5 billion. The Tax Agency refused this deduction. The company has appealed against the Tax Agency’s decision not to grant the deduction. The county administrative court has not yet notified a judgment on this matter.
